The deal.
In plain English.

These terms are the agreement between you and Constant when you use the app. We've kept them short and readable. Using Constant means you agree to them.

Who you're dealing with

Constant is operated by Gil Erez, doing business as Constant (forming as Constant Ltd in 2026). In these terms, "Constant," "we," "us," and "our" mean that operator; "you" means you, the person using the app. Contact: gil@trainconstant.com.

Agreeing to these terms

By creating an account or using Constant, you agree to these terms and to our Privacy Policy, which is part of this agreement. If you don't agree, don't use the app. If you're using Constant on behalf of someone else, you confirm you're allowed to bind them to these terms.

Who can use Constant

You must be at least 16 years old to use Constant, and old enough to form a binding contract where you live. Constant isn't directed to children under 16. You're responsible for keeping your account details accurate and for everything that happens under your account.

Coaching, not medical advice

This is the important one. Constant is a training-load coach. The engine reads your recovery signals and training history and writes a suggested session for the day. It is not a medical device, not a healthcare provider, not a physiotherapist, and not a substitute for professional medical or fitness advice. It does not diagnose, treat, or prescribe.

The plans, readiness states, and load suggestions are guidance, not instructions you must follow. You are the one deciding what to lift and how hard to train. Anything Constant captures about injuries, symptoms, or clinician notes is to help the engine program around you — it is not medical care.

Assumption of risk. Exercise carries an inherent risk of injury. Before starting or changing a training program you should talk to a qualified healthcare professional, especially if you have an injury, a medical condition, or any doubt. Warm up, use your own judgment on load, and stop if you feel pain or something is wrong. You train at your own risk, and you are responsible for your own safety and health decisions.

Your account

Keep your sign-in details secure and don't share your account. You're responsible for activity under your account. Tell us promptly at gil@trainconstant.com if you think someone else has accessed it. You can delete your account at any time (see Ending things below and the Privacy Policy for deletion).

Fair use of the app

When you use Constant, you agree not to:

  • break the law or use Constant for anything illegal or harmful;
  • upload someone else's personal or health data without their consent;
  • reverse-engineer, scrape, or copy the app, the engine, or its outputs, or try to extract the underlying model or training logic;
  • abuse, overload, or automate the AI features (food estimates, transcription, the coach engine) beyond normal personal use, or work around usage limits;
  • resell, sublicense, or commercially exploit Constant without our written permission;
  • interfere with the service's security or try to access other users' data.

Free and premium plans

Constant offers a free tier and a premium tier. Coaching, recovery sync, and activity linking are free; premium unlocks more AI-logging capacity, deeper history and analytics, a longer plan horizon, and the physio/doctor-visit recorder.

Paid subscriptions and billing are still rolling out. When they launch, we'll show the price and the billing period before you pay; subscriptions renew automatically until you cancel; you can cancel anytime and keep premium until the end of the period you've paid for. Purchases made through the Apple App Store are also subject to Apple's terms and are billed and refunded through Apple. Refunds are handled as required by applicable law (including Philippine consumer law) and as stated at the point of purchase. Until paid plans are live, premium access is granted manually and can change.

Your data, your content

Your data is yours — your profile, logs, notes, and the plans the engine writes for you. You grant us only the limited permission we need to run the service for you: to store, process, and display your data back to you, and to generate your coaching. We don't sell it and we don't train external models on it. How we handle it is set out in the Privacy Policy, including your rights to export and delete.

What's ours

Constant — the app, the brand and name, the coaching engine, the design, and the content we create — is owned by us and protected by intellectual-property law. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own training while you comply with these terms. That licence doesn't transfer any ownership to you.

Third-party services

Constant works with services we rely on — Apple Health, connected wearables (Whoop, Oura, Fitbit), Supabase, Vercel, Anthropic, OpenAI, and Resend. Your use of those features is also subject to those providers' own terms, and we're not responsible for them. Connecting or disconnecting them is your choice.

Availability, changes, and beta features

We're actively building Constant, so features change, get added, or get removed, and some are early/beta and may be rough. We aim for the app to be available and accurate but we can't guarantee uninterrupted, error-free service, and we may suspend or change parts of it (with notice where it matters). We don't promise the engine's suggestions are right for every person on every day — that's why your judgment stays in the loop.

Ending things

You can stop using Constant and delete your account at any time. We can suspend or close an account that breaks these terms, abuses the service, or creates risk for us or other users — we'll give notice where it's reasonable to. When an account ends, your right to use the app ends; the sections that by their nature should survive (disclaimers, liability limits, governing law) continue to apply.

Disclaimers

Constant is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties we're not legally required to give — including that the app will be uninterrupted, error-free, or fit for a particular purpose, and any warranty that its coaching outputs are medically appropriate for you. Some jurisdictions don't allow certain disclaimers, so parts of this may not apply to you.

Limit of our liability

To the fullest extent permitted by law, Constant and its operator aren't liable for indirect, incidental, special, or consequential losses, or for any loss arising from your training decisions, injuries, or reliance on the engine's suggestions. Where we are found liable, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 100. Nothing in these terms limits liability that can't be limited under applicable law (for example, for death or personal injury caused by our negligence, or fraud).

Indemnity

You agree to cover us for reasonable claims, losses, and costs that arise from your misuse of Constant or your breach of these terms — for example, uploading data you had no right to share.

Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws rules. If you have a problem, email us first at gil@trainconstant.com — most things are sorted out quickly that way. Any dispute that can't be resolved informally is subject to the exclusive jurisdiction of the competent courts of the Philippines, except where the law where you live gives you the right to bring a claim locally.

Changes to these terms

When we change these terms in a way that materially affects your rights, we'll email everyone with an account and update the date at the top. Smaller wording changes (typos, clarifications) we just date-stamp. Continuing to use Constant after a change means you accept the updated terms.
